The Land Division of the High Court has halted any move to demolish a multi billion shillings mansion belonging to Reverend Getrude Rwakatare which authorities say is standing on a protected area. Justice John Mugeta ruled yesterday that the court ruled on a similar matter in 2012 and declared that the plot where the house is built was legally surveyed and the project had not violated urban plans.
The area has registered title deeds number 2019 and 2020 issued in 1979. The house located along Ally Sykes street in Kawe Beach, is currently occupied by Reverend Rwakatare although the title deed shows that the plot belongs to her son, Robert Brighton.
Last week, the National Environmental Management Council (NEMC), earmarked the house for demolition, claiming it was built in a mangrove protected area at Mbezi Beach in Dar Es Salaam Tanzania.
However the court made the decision on Tuesday saying NEMC is against the earlier court decision therefore the house must not be demolished. This matter was taken to court by a lawyer representing Brighton Emmanuel asking the court to restrain the agency from pulling down the house.
