Judge Lubuva Speaks on New Constitution

Chairman of National Election Commitee (NEC) retired Judge Damian Lubuva said after the completion of general election which was held 25th October 2015, the committee is now ready to deal with the preparations for new constitution.

Judge Lubuva said this after some new constitution representatives asked Dr Magufuli to refuse opinion poll and allow for some changes to be done in the proposed constitution instead.

The process for securing new constitution for Tanzania entered flaws after some of CCM leaders rejected three government system which was proposed by retired judge Joseph Warioba. This was discussed throughout the country and it lead to the formation of Umoja wa Katiba ya Wananchi (UKAWA).

"We were waiting to finish the elections, just as Nyamwezi carry one load at a time, now we have finished the general election, we will now go to another, the referendum." judge Lubuva said.

"We are still looking into this, as a Comittee we will inform citizens about the situation, we suspended opinion poll so as we may deal with general election" Judge Lubuva added.

"This issue needs a huge budget and we have just dealt with general election, and the new government has just got into power, so it's an issue that we are still trying to study it and laiter we will inform the citizens" He added.

When he was asked how much money is needed to complete the process for attaining new constitution, judge Lubuva said "ask me that some other time, I don't have anything else to say."

However when president Magufuli was addressing Eleventh Parliament on November 20 he said:
"Let me assure you that we recognize and appreciate the great work done by patriotic citizens who participated in the initial stage of collection of views about the new constitution, the Constituent Review Commision, and the Consituent Assambly, which gave us the proposed constitution. We will perform our obligations as laid out in the Constitutional Act."

Other things UKAWA suggested and wanted to be included in the new constitution includes, Presidential candidate to be declared winner only after winning over 50% of citizens votes, ministers to be selected from non Member of Parliament, and presidential election results to be challenged in court.
